1. Introduction
1.1 This General Privacy and Data Protection Policy Statement of the AIP Foundation (the “Statement”) forms an integral part of the general terms and conditions of the AIP Foundation and governs all services and provisions offered by the AIP Foundation to its clients and any other relevant users (hereinafter the “User” or “You”, with “Your” referring directly to the User).

1.2 Your personal data is very important to the AIP Foundation, which is committed to doing its utmost to protect the personal data it collects, processes, or uses while providing its services to the User. This Statement outlines the objectives and principles governing the processing of Your data, the AIP Foundation’s obligations, and Your rights in this regard. Any collection and processing of personal data is carried out confidentially and in accordance with applicable Swiss and European laws, primarily the European General Data Protection Regulation (GDPR) and the Swiss Federal Data Protection Act (FADP).

1.3 The AIP Foundation reserves the right to modify this Statement and any related documents or information provided to the User or otherwise made freely accessible to the User at any time and without prior notice.

2. Personal Data Collected
2.1 The AIP Foundation processes personal data that You voluntarily provide, including but not limited to when You contact the AIP Foundation (via email, mail, or any other available means), register Your children, fill in an AIP Foundation form, apply for a job, accept a job offer, participate in a survey, or subscribe to any services offered by the AIP Foundation.

2.2 The personal data that may be collected and processed by the AIP Foundation includes, but is not limited to: name, first name, nationality, email, phone number, address, country, field, level of education, work permit, and documents such as CVs, cover letters, and diplomas.

3. Processing of Personal Data (Art. 6 GDPR)
3.1 The data collected by the AIP Foundation is generally used to improve the quality of the services the Foundation offers, as agreed to by the User. To this end, the AIP Foundation creates and processes files containing the personal data of its students to efficiently manage their registration and admission into the Foundation, as well as to manage their academic progress and any subsequent contractual relationships with the User, their legal representatives, and other relevant parties. The same procedure applies to job applicants and employees of the AIP Foundation during the recruitment process and the management of the employment relationship.

3.2 Access to User data is restricted to internal use (employees or agents of the AIP Foundation). The AIP Foundation does not use collected data for purposes other than those mentioned in this Statement or in other similar documents published on its website or provided to the User. The AIP Foundation may share personal data with external contractual partners, such as service providers or agents appointed by the AIP Foundation for the execution of the services offered and related tasks. Any such external contractual partner is subject to the same confidentiality requirements and obligations as those guaranteed by the AIP Foundation to its Users. The AIP Foundation does not disclose Users’ personal data to third parties unless the concerned User has given their consent or if a legal provision allows or requires such disclosure.

3.3 The AIP Foundation maintains a record of processing activities (Art. 30 GDPR), which includes the following information: (i) the name and contact details of the data controller, (ii) the purposes of the processing, (iii) a description of the categories of data subjects and categories of personal data, (iv) the categories of recipients to whom the personal data has been or will be disclosed, and (v) where possible, a general description of the technical and organizational security measures implemented by the AIP Foundation.

4. Duration of Personal Data Processing
4.1 Your data is stored and processed as long as necessary to fulfill the legal and contractual obligations of the AIP Foundation, except in the cases outlined in Article 5.1 below.

5. Your Rights
5.1 Every User has the right to access their personal data processed by the AIP Foundation. They also have the right to rectification, erasure (“right to be forgotten”), restriction of processing, objection, where applicable, data portability, and the right to lodge a complaint. Any such request must be sent to the AIP Foundation’s Data Protection Officer at the contact details listed in Article 6 of this Statement.

5.2 The User may withdraw their consent to the processing of their personal data at any time. However, the AIP Foundation informs the User that, in the event of withdrawal of consent or a request for processing restriction, some services provided by the AIP Foundation may no longer be available to the User.

5.3 It is important that the data processed by the AIP Foundation is complete and up to date, and it is the sole responsibility of the User to ensure the data provided to and processed by the AIP Foundation is accurate. The User is responsible for notifying the AIP Foundation of any changes.

6. Contact

6.1 Within the limits of applicable legal provisions, all questions and requests from the User regarding the processing of their data by the AIP Foundation or regarding the exercise of a right listed in Article 5.1 should be addressed to the AIP Foundation’s Data Protection Officer as follows:

6.2 The AIP Foundation’s Data Protection Officer will respond to the User’s request within one (1) month, which may be extended (upon request before the initial deadline) by two (2) months in cases of complex requests or a high volume of requests.

6.3 If a User wishes to file a complaint with the supervisory authority, the complaint should be submitted to the Swiss Federal Data Protection and Information Commissioner or, if the User resides in the European Union, to the supervisory authority of their country of residence. The User is encouraged to first contact the AIP Foundation in order to attempt to resolve the situation amicably.

6.4 This policy is written in both French and English. In the event of a discrepancy between the two versions, the French version shall prevail and be deemed authoritative.
